Town o flash ee <br /> MASHPEE ZONING BOARD OF APPEALS <br /> 16 great JVeck load Xorth <br /> Mashpee,Massachusetts 02649 <br /> Decision for a Chapter 40B Comprehensive Permit <br /> RE: Habitat for Humanity Chapter 40B 29 Sandy Fox Drive <br /> Map 28 Parcel 78 <br /> SP-02-142 <br /> A Petition was filed on November 14, 2002 by Habitat for Humanity of Cape Cod <br /> for a Chapter 40B Comprehensive Permit under Section 174-31 of the Zoning By-laws to <br /> vary the land space requirements and frontage requirements to allow for construction of <br /> one moderate income home on property located in an R-5 zoning district at 29 Sandy Fox <br /> Drive (Map 28 Parcel 78) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee,November 29 and December <br /> 6, 2002, a copy of which is attached hereto and made a part hereof. <br /> I ' <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on I f <br /> Wednesday, December 11, 2002, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Robert G. <br /> Nelson and Edward Govoni. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the I <br /> provisions of Massachusetts General Laws, Chapter 40B and the Town of Mashpee <br /> Zoning By-laws. <br /> Mr. Donald S. Dickinson, President of Habitat for Humanity of Cape Cod, j <br /> represented the Petitions and stated that Habitat for Humanity is a non-profit organization <br /> and is the developer for this project. He said that the intent of Chapter 40B is to <br /> encourage development of affordable housing in Towns and cities in Massachusetts. <br /> Within the guidelines of Chapter 40B, a Town can encourage and allow development of <br /> affordable housing by accepting a proposal as a Local Initiative Project. <br /> Mr. Dickinson said that thero'ect calls for construction of one affordable three- <br /> bedroom, <br /> , <br /> bedroom, two-story home. There will be the opportunity for a fourth bedroom in this unit <br /> should the family need it and the septic system has been designed accordingly. The <br /> Petitioner is also requesting the setbacks for the lot frontage be varied since the <br /> requirement is 150 feet and this lot only has 120 feet. The lot is also undersized at 15,000 <br /> square feet since the current zoning requires 80,000 square feet. They are requesting this <br /> be exempt as well. Habitat for Humanity endeavors to construct in modestly priced <br /> neighborhoods where the affordable homes would fit in with the neighborhood and would <br /> not reduce the value of the existing homes. The home would also be sold in perpetuity. <br />
