A new septic system is going in and this will <br /> be an improvement to the property. <br /> L <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 5 Keel Way and consists of 15,002 <br /> I ' <br /> square feet. <br /> j <br /> ' I <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General 1 �' <br /> Law Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> j Ii P <br /> non-conforming use. <br /> i <br /> SPECIFIC FINDINGS j I <br /> 1. that the proposed construction conforms to the setback requirements. <br /> 2. that the proposed construction shall be an improvement to the neighborhood. <br /> 3. that the proposed installation of a new Title V septic system shall be an h <br /> i <br /> improvement to the subject lot. j <br /> i <br /> 4. While the proposed construction will increase the non-conforming nature of <br /> the structure, the changes will not result in a structure or use which is more <br /> detrimental to the neighborhood than the prior non-conforming structure and <br /> G. <br /> its use. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the i{ j <br /> applicant met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on November <br /> 13, 2002 to grant a Special Permit.
