Lapham V-00-3 <br /> GENERAL FINDINGS <br /> 1. that the subject lot is located at 24 Tobisset Street and consists of 15,305 <br /> square feet. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> n that there are circumstances relating to the shape and topography which affect this lot and <br /> i; <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> (Y involve hardship to the petitioner. <br /> t SPECIFIC FINDINGS <br /> 1. that a literal enforcement of the By-laws would involve hardship to the <br /> petitioner. <br /> 2. that relief may be granted without detriment to-the public good. <br /> r <br /> 3. that relief may be granted without derogating from the intent or purpose of the <br /> By-laws. <br /> 4. that the shape and topography affect the subject lot and not the district in <br /> which it is located. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded,the Zoning Board of Appeals voted unanimously on January 12, <br /> 2000 to grant the following: <br /> 1. a Variance of 2.5 feet from the easterly side of the lot. <br /> 4v' <br /> 2. a Variance of 6.4 feet from the westerly side of lot. <br /> t� <br /> ' The Variance is conditioned upon compliance with Canal Land Surveying Plan <br /> F entitled"Plot Plan Showing Proposed Additions, Lot 90 A, Tobisset Street, Mashpee, <br /> MA, Scale 1"=30', January 7, 2000, Project Number 00-003"and Living Designs Plan <br /> F' <br /> entitled"Cape &Islands Home Improvement, Pelczarski Residence, 24 Tobisset Street, <br /> Mashpee, Date: 23-Dec-99, Project No.: 99-1177". <br />
