Colombo SP-00-5 2 <br /> Board of Appeals <br /> GENERAL FINDINGS <br /> tom; <br /> I. that the subject lot is located at 440 Nathan Ellis Highway and consists of 1.94 <br /> w acres of land. <br /> SPECIAL PERMIT CRITERIA <br /> Section 9 of Chapter 40A and Section 174-24C of the Mashpee Zoning <br /> By-law require that the permit granting authority determine that the proposed use <br /> and development are consistent with applicable law, rules and regulations; that there <br /> will be no adverse effect on public health or safety;that there will not be an excessive <br /> demand upon community facilities created as a result of the proposal; and that there <br /> will not be a significant adverse impact on the environmental factors listed in Section <br /> 174-24.C.2. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on January <br /> 12, 2000 to grant the Special Permit. The Special Permit is conditioned upon the <br /> following: <br /> 1. that no more than two vehicles for sale shall be parked in the front of the <br /> subject property. <br /> 2. that no more than four vehicles for sale shall be parked in the rear of the <br /> subject property at any one time. <br /> 3. that no maintenance or servicing(such as, but not limited to, oil change, <br /> washing, repairing) of vehicles shall be done on the subject property. <br /> 4. that no signage (other than on the vehicle for sale) advertising sale of vehicles <br /> shall be erected on the subject property. <br /> 5. that no cube or box trucks for sale shall be parked on the subject property. <br /> 6. that the sale of only full-size vans or vehicles shall be allowed on the subject <br /> property. <br /> 7. that the Special Permit shall expire one year from the date that the Zoning <br /> Board of Appeals has filed it with the Town Clerk. <br /> 8. that the applicant must request a renewal of the Special Permit from the <br /> Zoning Board of Appeals at least one month before the expiration of the <br /> Special Permit. <br /> 9. that the Zoning Board of Appeals shall review the Special Permit for renewal. <br />
