Mashpee Zoning John B. &Elaine Wilson V-00-22 2 <br /> Board of Appeals <br /> it <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would I' <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS <br /> 1. that there are circumstances relating to the shape and topography that affect <br /> the subject lot and not the district in which it is located. <br /> 2. that a literal enforcement of the By-laws would involve hardship to the <br /> Petitioner. <br /> 3. that relief may be granted without detriment to the public good. <br /> 4. that the subject property fronts on Great River and is impacted by wetlands. <br /> 5. that the Board determined that without relief the lot could not be used fora <br /> residence,the purpose for which it had been laid out and for which the <br /> balance of the undersized lots in the subdivision were being used. <br /> i <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded,the Zoning Board of Appeals voted unanimously on February 23, <br /> 2000 to grant the following: j <br /> • a Variance of 13 feet from the front setback requirements to Overland Road. j <br /> i <br /> • a Variance of 1 foot on the 49-foot dimension to the edge of the uplands on the <br /> northerly side of the lot. I <br /> • a Variance of 12 feet on the 38-foot dimension to the edge of the uplands on the <br /> northerly side of the lot. <br /> a Variance of 33 feet on the 17-foot dimension to the edge of the uplands on the <br /> northerly side of the lot. <br /> II <br /> • a Variance of 42 feet on the 8-foot dimension on the southerly side of the lot. <br /> • a Variance of 30 feet on the 20-foot dimension on the southerly side of the lot. <br /> • a Variance of 17 feet on the 33-foot dimension on the southerly side of the lot. <br /> • a Variance of 43 feet on the 7-foot dimension on the southerly side of the lot. j <br /> • a Variance of 23 feet on the 7-foot dimension to Overland Road on the southerly side <br /> of the lot. j <br /> The Variance is <br /> conditioned upon compliance with Cape & Islands Engineering <br /> p P P g g � <br /> Plans entitled"House Reconstruction& Septic Upgrade, Proposed Sewage Disposal <br /> System, Prepared for John Wilson, Hse.No. 202 Monomoscoy Road, Mashpee, Mass., j <br /> Date: Dec. 8, 1999, Plan No. 5120899" and"Site Plan Located in Mashpee—Mass., <br /> Prepared for John Wilson, Date: Dec. 16, 1999, Plan No. 121699". <br /> I <br /> i <br /> i <br />
