Mr. Tavares withdrew the <br /> � I <br /> request for a front setback Variance and submitted revised plans with the proposed III <br /> addition conforming to the 30-foot front setback requirement. <br /> f i <br /> Mr. Marcel Murad, a direct abutter, expressed approval of the project. <br /> GENERAL FINDINGS <br /> 1. that the subject lot is located at 15 Keel Way and consists of 16,590 square <br /> feet. <br /> I ii ISI <br /> I <br /> VARIANCE CRITERIA I' <br /> Section 10 of Chapter 40A requires that the permit granting authority determine III <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> I <br /> SPECIFIC FINDINGS <br /> 1. that there are circumstances relating to the shape and topography that affect <br /> � II <br /> the subject lot and not the district in which it is located. <br /> 2. that a literal enforcement of the By-laws would involve hardship to the <br /> Petitioner. <br /> 3. that relief may be granted without detriment to the public good. <br /> 4. that relief may be granted without derogating from the intent or purpose of the <br /> By-laws. <br /> 5. that the shape and topography affect the subject lot and not the district in j <br /> which it is located. <br /> 6. that the subject property fronts on Great River and is acted b <br /> p y wetlands. <br /> impacted <br /> 7. that lot coverage would be less than the allowed 30%. <br /> 8. that the request for a Variance from the front setback requirements was j r, <br /> withdrawn. II <br /> � I <br /> � SII <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the I, <br /> applicant met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded,the Zoning Board of Appeals voted unanimously on March 8, 2000 <br /> to grant a Variance of 12 feet from the sideline setback requirements and a Variance of <br /> I <br /> 8.65 feet from the setback requirements from the water and wetlands. The Variance is �( <br /> conditioned upon compliance with Tavares Land Design plan entitled"A Swimming <br /> Pool and Landscape and Site Development Plan for: Lloyd&Roberta Gainsboro, 15 <br /> Keel Way, Little Neck Bay, Revised: 01-17-2000, 01-30-2000, 03-05-2000". <br />
