Owner I; <br /> of record: Ann M. Carboneau, et al, Trustees. II <br /> i <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> ' i <br /> a newspaper of general circulation in the Town of Mashpee, on February 18 and <br /> February 25, 2000, a copy of which is attached hereto and made a part hereof. <br /> The Board received a fax on March 6, 2000 from Mashpee Auto Brokers <br /> p <br /> requesting a continuance of the Petition for a Special Permit. At the Public Hearings <br /> on March 8, 2000,the Board voted unanimously to continue the Petition until March 22, <br /> 2000. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, March 22, 2000, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert G.Nelson,Marshall A. Brem and <br /> Frederick R. Borgeson. <br /> ! <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. l ; <br /> Mr. Paul Moore represented his application and stated that he has been operating <br /> a car-sale business under the name of B &M Auto Brokers across the street from Deer <br /> Crossing. He stated that he has outgrown his current location and is seeking permission <br /> to move his business across the street to the Deer Crossing parking lot. Mr. Moore would <br /> occupy an office space above the Market Place. <br /> Marjorie Katsoulis and Angie Bernhardt, abutters at 661 Falmouth Road, claimed <br /> that some of the Deer Crossing condominium residents were not notified of the Public <br /> Hearings and requested a continuance of the hearing. Ms. Katsoulis expressed concern <br /> that this type of business would detract from the value of her property. <br /> The Board voted to continue the hearing until May 10, 2000 to allow Mr. Moore <br /> an opportunity to submit a professionally surveyed plan showing the physical distance <br /> from the right-of-way to the parking lot in order for the Board to determine the 50-foot <br /> i <br />
