Levine of Boston, <br /> on <br /> Massachusetts for a Variance from Sections 174-33 and 174-86 of the Zoning <br /> By-laws for permission to vary the setback requirements from the water and wetlands <br /> and the setback requirements from <br /> q the ACE <br /> C to allow for construction of a single-family <br /> home on property located in an R-3 zoning district at 1 Waterline North Drive (Map 120 <br /> Block 172)Mashpee,p , MA. <br /> I I <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> I <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on March 24 and March 31, <br /> 2000, a copy of which is attached hereto and made a part hereof. <br /> I <br /> Attorney Robert Mills requested a continuance of the Petition to allow the <br /> applicant an opportunity to receive Conservation Commission approval. At the Public <br /> i <br /> Hearings on April 12, 2000, the Board voted unanimously to continue the Petition until <br /> May 10, 2000. <br /> � I <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 10, 2000, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III and <br /> Robert G. Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Robert Mills represented the applicant and submitted photos of the <br /> property. Ms. Arlene Wilson, architect for the project, also attended the meeting and <br /> stated that the entire lot lies within the ACEC. <br /> The Board of Health and the Conservation Commission have approved the plan. <br /> No comments were received from abutters. a <br />
