Levine V-00-105 2 <br /> Board of Appeals <br /> GENERAL FINDINGS <br /> .3 <br /> 1- that the subject property is located at 1 Waterline North Drive and consists of <br /> 19,200 square feet. <br /> VARIANCE CRITERIA <br /> i <br /> Section 10 of Chapter 40A requires that the permit granting authority determine x <br /> that there are circumstances relating to the shape and topography which affect this and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS <br /> 1. that there are circumstances relating to the shape and topography that affect <br /> the subject lot and not the district in which it is located. <br /> 2. that a literal enforcement of the By-laws would involve hardship to the <br /> Petitioner. <br /> 3. that relief may be granted without detriment to theu <br /> p bhcg ood. <br /> 4. that the subject property fronts on Jehu Pond and is impacted by wetlands. <br /> 5. that the Board determined that without relief the lot could not be used for a <br /> I <br /> residence, the purpose for which it had been laid out and for which the <br /> balance of the undersized lots in the subdivision were being used. <br /> 6. that the installation of a new denitrification system would be an improvement <br /> j <br /> to the property. <br /> 7. that the Board has granted the applicant a Special Permit to demolish an <br /> existing dwelling and construct a single-family home on the subject lot. <br /> In view of the <br /> foregoing, the Mashpee Zoning Board of Appeals fo <br /> and that the <br /> applicant met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded,the ZoningBoard of Appeals voted unanimous) on May 10 2000 to <br /> pP <br /> Y Y <br /> grant a Variance of 12 feet from the setback requirements to the water and wetlands.
