Mashpee Zoning Alexander M. Levine V-00-105 2 Board of Appeals GENERAL FINDINGS .3 1- that the subject property is located at 1 Waterline North Drive and consists of 19,200 square feet. VARIANCE CRITERIA i Section 10 of Chapter 40A requires that the permit granting authority determine x that there are circumstances relating to the shape and topography which affect this and not the district in which it is located and that a literal enforcement of the By-laws would involve hardship to the petitioner. SPECIFIC FINDINGS 1. that there are circumstances relating to the shape and topography that affect the subject lot and not the district in which it is located. 2. that a literal enforcement of the By-laws would involve hardship to the Petitioner. 3. that relief may be granted without detriment to theu p bhcg ood. 4. that the subject property fronts on Jehu Pond and is impacted by wetlands. 5. that the Board determined that without relief the lot could not be used for a I residence, the purpose for which it had been laid out and for which the balance of the undersized lots in the subdivision were being used. 6. that the installation of a new denitrification system would be an improvement j to the property. 7. that the Board has granted the applicant a Special Permit to demolish an existing dwelling and construct a single-family home on the subject lot. In view of the foregoing, the Mashpee Zoning Board of Appeals fo and that the applicant met the criteria necessary for the granting of a Variance. Upon motion duly made and seconded,the ZoningBoard of Appeals voted unanimous) on May 10 2000 to pP Y Y grant a Variance of 12 feet from the setback requirements to the water and wetlands. The Special Permit is conditioned upon compliance with A. M.
