Driscoll of <br /> Melrose, Massachusetts for a Special Permit under Section 174-20 of the Zoning By-laws <br /> for permission to demolish an existing structure and construct a single-family home on <br /> property located in an R-3 zoning district at 12 Riverside Road <br /> Mashpee, M.A. (Map 119 Block 113) <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice wasiven b � <br /> g y publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on April 7 and April 14, <br /> 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 26, 2000, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Robert <br /> G. Nelson and Frederick R. Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. and Mrs. Driscoll represented their application and stated that the existing <br /> cottage would be demolished and replaced with a new home. They asked for permission <br /> to leave the existing structure on the lot until construction is completed on the new home. } <br /> The 16 x 16-foot shed would be relocated to accommodate construction of the garage. <br /> Building Commissioner William F. Hauck stated that there are no setback <br /> requirements for the lot because it was created in 1936. He said that once an existing <br /> structure is demolished, it creates a vacant lot requiring the owner to meet current <br /> zoning. The Board has the authority to grant Variances from the setback requirements <br /> under the Petition for a Special Permit because the existing structure is pre-existing <br /> and non-conforming <br /> The Board voted unanimously to continue the hearing until May 10, 2000 to allow <br /> the applicant an opportunity to submit certified, engineered plans showing proposed lot <br /> coverage and dimensions from the property lines to the proposed construction. <br /> ,x <br />
