Driscoll SP-00-111 2 <br /> Board of Appeals <br /> At the continued hearings on May 10, 2000, Mr. John Slavinsky of Cape& <br /> Islands Engineering represented the applicants and referred to the architectural plans and ? �x <br /> the dimensioned engineering plans. The existing shed consists of 2.2% lot coverage with <br /> a proposed additional 20.8% lot coverage with the new construction. <br /> r- .sir <br /> A new septic system would replace the existing cesspool. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject lot is located at 12 Riverside Road and consists of 11,710 <br /> square feet. <br /> SPECIAL PERMIT CRITERIA ,n <br /> L" <br /> Code of the Town of Mashpee § 174-20 states: "Rebuilding of destroyed or <br /> damaged non-conforming structure. Any non-conforming building or structure destroyed <br /> or damaged by fire, flood lightning, wind or otherwise may be rebuilt, subject to approval ` <br /> of the Board of Appeals subject to the same conditions as set forth in§ 174-24 of this <br /> chapter." y `k <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessaryfor the <br /> granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on May 10, <br /> 2000 to grant a Special Permit to allow for construction of the new home. The Special <br /> Permit is conditioned upon compliance with the following: <br /> I. Cape & Islands Engineering plan entitled: "Septic System Upgrade, Proposed <br /> Sewage Disposal System, Prepared for John Driscoll, Hse.No. 12 Riverside <br /> Rd., Mashpee—Mass., Date: July 12, 1999, Revised: 3/10/00 and 5/3/00". <br /> 2. that until such time that the new construction is completed,the existing .Y'. ., <br /> dwelling shall be allowed to remain on the subject lot. F <br /> 3. that once the new construction is completed,the old dwelling shall be <br /> demolished and construction of the garage can commence. <br /> 4. that an occupancy permit from the Building Department shall not be issued <br /> until after demolition of the old dwelling and complete construction of the <br /> new home. <br /> 5. that the existing shed as shown on the above-referenced plan is not approved <br /> by the Board at this time and must be either demolished or removed from the <br /> lot. <br /> 6. that the applicant has the right to request a Variance from the Board for <br /> installation of the shed at a later time. <br /> 7. that the Board grants the applicant a Variance to exceed the 20% lot coverage. <br /> 3 <br /> ywj� <br />
