Costa, Sr., Trustee V-00-119 17 Huron Avenue <br /> s, <br /> Map 65 Block 24 <br /> I A Petition was filed on April 7, 2000 by Ronald J. Costa, Sr., Trustee, of Punta <br /> Gorda, Florida for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the lot size requirements and the frontage requirements to allow for construction <br /> of a single-family home on property located in an R-3 zoning district at 17 Huron Avenue <br /> (Map 65 Block 24)Mashpee, MA. Owner of record: Costa Family Trust, Ronald J. <br /> Costa, Sr., Trustee. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on April 21 and April 28, <br /> 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 10, 2000, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert G.Nelson, Marshall A. Brem and <br /> Frederick R. Borgeson. Messrs. Govoni, Regan and Guerrera stepped down and left the <br /> room. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the applicant and <br /> stated that the lot has been in separate ownership since July 1981. The lot contains 73.5 <br /> feet of frontage and 16,080 square feet of land. Mr. Slavinsky submitted a copy of the <br /> Assessor's map of the area and pointed out that virtually all of the lots in the area are . <br /> smaller than the subject property. A lot directly across the street from the subject lot with <br /> the same amount of frontage was recently developed. <br /> Mr. and Mrs. Gene MacDonald, abutters, voiced opposition to the project. They <br /> said that they are concerned with the value of their home depreciating because the subject <br /> lot is too small to be developed. They submitted a petition signed by 20 abutters and <br /> neighbors who are also opposed to the project. <br /> Ms. Janice Condron, a direct abutter,told the Board that Mr. Costa bought the lot f <br /> in 1995 to park cars and claimed that he knew then that the lot was unbuildable. Ms. <br /> Dorothy Harper, another abutter, also objected to the proposed construction on the small <br /> lot. <br />
