Several of the <br /> Board members plan to visit the subject property. r <br /> At the continued hearings on June 28, 2000, Mr. Nelson stated that he visited the <br /> subject lot and said that the subject lot is as large or larger than the other lots in the area. <br /> � <br /> He also stated that its frontage is equal to the frontage of either of the two lots r� g q g directly <br /> across the street. Mr. Borgeson stated that he also visited the site and concurred with Mr. <br /> r Nelson's findings. <br /> z Building Inspector Russell W. Wheeler conducted a deed search and found that <br /> .f the subject lot has been in separate ownership and is a buildable lot. <br /> ' GENERAL FINDINGS <br /> 1. that the subject property is located at 17 Huron Avenue and consists of 16,080 <br /> square feet. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS <br /> 1. that there are circumstances relating to the shape and topography that affect <br /> the subject lot and not the district in which it is located. <br /> 2. that a literal enforcement of the By-laws would involve hardship to the <br /> Petitioner. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the R <br /> applicant met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded,the Zoning Board of Appeals voted unanimously on June 28, 2000 to <br /> f grant a Variance of 76.45 feet from the frontage requirements and a Variance of 23,920 <br /> 'j square feet from the lot size requirements. The Variance is conditioned upon compliance <br /> with Cape &Islands Engineering plan entitled"Single Family Residence &Proposed <br /> _r Sewage Disposal System, Prepared for Costa Family Trust,Hse.
