Mashpee Zoning Alberto Velella, Trustee SP-00-141 2 <br /> Board of Appeals <br /> Hauck confirmed that the Town By-laws do not allow for installation of a pier, ramp and <br /> float on a lot on which there is no house constructed. <br /> No comments were received from abutters. it <br /> GENERAL FINDINGS ! <br /> i <br /> 1. that the subject lot is located at 407 Monomoscoy Road and consists of 41,400 <br /> square feet fronting on Little River. <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-25.I.9 states that the Board must find that the structure will not II <br /> unduly interfere with the free passage of travel by water or land or cause or contribute to <br /> the substantial disruption or degradation of the marine or coastal environment. <br /> SPECIFIC FINDINGS l <br /> 1. that the proposed dock would be an accessory to the proposed dwelling and is <br /> a permissible use upon the grant of a Special Permit. l <br /> 2. that the proposal has been reviewed by the Conservation Commission to <br /> address impacts on the coastal environment. <br /> 3. that the use is in harmony with the general purpose and intent of the By-laws. <br /> 4. that the owner has rights to maintenance in perpetuity. <br /> 5. that filing with the Corps of Engineers shall be considered execution of the <br /> u 4 <br /> Special Permit. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion f <br /> i <br /> duly made and seconded,the Zoning Board of Appeals voted unanimously on July 12, <br /> 2000 to grant a Special Permit. The Special Permit is conditioned upon compliance with <br /> the following: <br /> I <br /> 1. that construction of the proposed house must be started within two years.
