Crichton SP-00-149 111 Shore Drive <br /> Map 117 Block 335 <br /> A Petition was filed on July 6, 2000 by Ralph J. &Doris M. Crichton of Mashpee, <br /> Massachusetts for a Special Permit under Section 174-25.A.8 of the Zoning By-laws to <br /> allow for a pre-existing, non-conforming two-family home on property located in an R-3 <br /> I <br /> zoning district at 111 Shore Drive (Map 117 Block 335)Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> I I . <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on July 21 and July 28, 2000, <br /> a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on j <br /> Wednesday, August 9, 2000, at which time the following members of the Zoning Board j ,I <br /> of Appeals were present and acting throughout: Edward M. Govoni, Richard T. Guerrera <br /> and Frederick R. Borgeson. Mr. Regan stepped down and left the room. j <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of �I <br /> Mashpee Zoning By-laws. <br /> Mr. Brad Caffyn of Seaview Real Estate represented the Petition and <br /> p I <br /> submitted photos of the subject property. He stated that the dwelling has been in <br /> existence for over 50 years and that the Town has always taxed the dwelling as <br /> a two-family residence. Mr. Ca <br /> ffyn asked the Board to grant the Special Permit to <br /> allow the potential buyer of the property to continue to use the home as a two-family <br /> residence. <br /> Mr. Caffyn submitted letters from several neighbors in favor of the Petition. <br /> Several of the neighbors attended the meeting and expressed app project. <br /> roval of theI <br /> Mr. Govoni read a memo from the Fire Department that referred to Section 47-4 <br /> of the Town By-laws and requested the installation of a"heat detector system, <br /> transmitting to a U.L. Listed Central receiving station"in the two-family residence. <br /> Mr. Govoni also read a letter from Mr. and Mrs. James A. Krizansky, abutters at <br /> i <br /> 119 Shore Drive, in opposition to the proposal. Mr. Krizansky attended the meeting and <br /> questioned why the dwelling does not have to meet current zoning requirements and why <br /> the proposal does not have to look like a single-family dwelling. He expressed concern <br /> with the new owner modifying and adding another story to the existing dwelling. <br /> I <br />
