Crichton SP-00-149 2 <br /> Board of Appeals <br /> The Board assured Mr. Krizansky that any modification, expansion or alteration <br /> to the subject property would require approval from the Zoning Board of Appeals. Mr. <br /> Govoni further stated that the dwelling predates zoning by-laws by many years and is <br /> protected under"grandfathering", i I <br /> GENERAL FINDINGS ! <br /> 1. that the subject property is located at 111 Shore Drive and consists of 6,000 <br /> square feet. <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br /> Laws Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. <br /> I I <br /> SPECIFIC FINDINGS <br /> 1. that the dwelling at 111 Shore Drive is a pre-existing, non-conforming <br /> structure. <br /> 2. that the Town of Mashpee has always taxed the subject dwelling as a <br /> two-family home. <br /> 3. that any further changes/modifications/alterations/expansions to the subject <br /> dwelling would require approval from the Zoning Board of Appeals. <br /> 4. that the Board has granted Variances from the setback requirements to allow <br /> for construction of the proposed decks to property located at 111 Shore Drive. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on August 9, <br /> 2000 to grant the Special Permit. The Special Permit is conditioned upon compliance <br /> with the following: <br /> 1. Cape & Islands Engineering plan entitled"Plot Plan of Land Located in <br /> Mashpee—Mass., Prepared for Ralph Crichton, Date: June 23, 2000". <br /> 2. installation of a heat detector system transmitting to a U.L.
