Smith of North Attleboro, ' <br /> Massachusetts for a Special Permit under Section 174-20 of the Zoning By-laws for <br /> �I <br /> permission to demolish an existing dwelling and construct a new single-family home on <br /> property located in an R-3 zoning district at 66 Spoondrift Way(Map 112 Block 40) �! <br /> Mashpee, MA. <br /> I . <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> Ili <br /> newspaper of general circulation in the Town of Mashpee, on August 4 and August 11, <br /> 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 23, 2000, at which time the following members of the Zoning Board U'I <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Robert G. Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Sanicki of Cape & Islands Engineering and Architect Anthony Ferragamo <br /> represented the Petition. Mr. Sanicki submitted photos of the existing dwelling that is to <br /> be demolished. He stated that construction of the new home would be 55 feet from the <br /> water and wetlands and would meet the other setback requirements. A small portion of <br /> the proposed deck would encroach on the setback requirements from the water and <br /> wetlands. Mr. Ferragamo confirmed that the septic system issues dictate the location of <br /> the proposed construction. <br /> The Conservation Commission has approved the project. <br /> No continents were received from abutters. <br /> illy � <br /> I <br />
