Esper V-00-193 2 Board of Appeals At the continued hearings on December 13, 2000,Mr. John Slavinsky of Cape & Islands Engineering represented the Petition and stated that the President of the Seabrook Meadows Association indicated that the Association no longer objects to the proposal. Mr. Slavinsky said that any zoning relief granted by the Board would still require approval from Seabrook Meadows Association. j! I The Board of Health has approved the project. VARIANCE CRITERIA i Section 10 of Chapter 40A requires that the permit granting authority determine that there are circumstances relating to the shape and topography which affect this lot and not the district in which it is located and that a literal enforcement of the By-laws would involve hardship to the petitioner. GENERAL FINDINGS I 1. that the subject property is located at Meadowbrook Drive and consists of j ii 1 17,729 square feet. II SPECIFIC FINDINGS The Board determined that: l i 1. the proposal would be well under the 30% lot coverage allowed in a cluster III , subdivision; therefore, relief may be granted without derogating from the intent or purpose of the By-laws. I i In view of the foregoing, the Mashpee Zoning Board of Appeals found that the 'I f Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly 1 made and seconded the ZoningBoard of Appeals voted unanimous) on December 13 pP Y 2000 to grant a Variance of 2 feet on the northeasterly side of the property. The Variance it is conditioned upon compliance with the following: 1. Cape & Islands Engineering plan entitled"Plot Plan of Land Located in Mashpee—Mass., Prepared for Raymond Esper, Date: Oct. 13, 1989, Rev'd ! j 10/10/00". j l 2. written confirmation from the Association that it has withdrawn its objection to the proposal. l Ili! i I '
