Esper V-00-193 2 <br /> Board of Appeals <br /> At the continued hearings on December 13, 2000,Mr. John Slavinsky of Cape & <br /> Islands Engineering represented the Petition and stated that the President of the Seabrook <br /> Meadows Association indicated that the Association no longer objects to the proposal. <br /> Mr. Slavinsky said that any zoning relief granted by the Board would still require <br /> approval from Seabrook Meadows Association. j! I <br /> The Board of Health has approved the project. <br /> VARIANCE CRITERIA <br /> i <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> GENERAL FINDINGS I <br /> 1. that the subject property is located at Meadowbrook Drive and consists of j ii 1 <br /> 17,729 square feet. II <br /> SPECIFIC FINDINGS <br /> The Board determined that: l i <br /> 1. the proposal would be well under the 30% lot coverage allowed in a cluster <br /> III , <br /> subdivision; therefore, relief may be granted without derogating from the <br /> intent or purpose of the By-laws. <br /> I i <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the 'I f <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> 1 <br /> made and seconded the ZoningBoard of Appeals voted unanimous) on December 13 <br /> pP Y <br /> 2000 to grant a Variance of 2 feet on the northeasterly side of the property. The Variance it <br /> is conditioned upon compliance with the following: <br /> 1.
