East, Jr. V-00-200 <br /> 2 <br /> Board of Appeals <br /> GENERAL FINDINGS <br /> i <br /> 1. that the subject lot is located at 22 Wilson's Grove and consists of 2,250 <br /> � . <br /> square feet. i I <br /> SPECIFIC FINDINGS E <br /> The Board determined that: <br /> Ili! <br /> 1. without relief the lot could not be used for a residence' the purpose for which <br /> it had been laid out and for which the balance of the undersized lots in the f <br /> subdivision were being used; therefore, relief may be granted without <br /> derogating from the intent or purpose of the By-laws. <br /> 2. the lot's narrow shape affects the subject lot and not the district in which it is <br /> located. <br /> 3. due to the extremely small size of the lot, a literal enforcement of the front <br /> setback, side setback and lot coverage requirements would involve hardship to <br /> the Petitioner. <br /> 4. installation of a new septic system would be an improvement to the property <br /> and to the neighborhood; therefore, relief may be granted without detriment to <br /> the public good. <br /> it . <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the j ! <br /> applicant met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on November 22, !! <br /> 2000 to grant the following: <br /> 1. a Variance of 18 feet from the front setback requirements. <br /> 2. a Variance of 1.5% from the lot coverage requirements. <br /> The Variance is conditioned upon compliance with the following: <br /> 1. document entitled "Calculation of Lot Coverage, 22 Wilson's Grove, Map �! <br /> 118, Block 75, October 10, 2000, George H. East, Jr. Registered Professional <br /> Engineer". <br /> 2. New England Design plan entitled"George East Residence, 22 Wilson's j <br /> Grove, Mashpee, MA., Date: 8/4/00, Revised 10/6/00, File Name: 0001A1". <br /> 3. that the outdoor shower shall not exceed 4'x6' in size. <br />
