Viglas of j! <br /> Winchester, Massachusetts for a Special Permit under Section 174-25.L9 of the Zoning <br /> By-laws for permission to construct a pier, ramp and float on Popponesset Bay on l <br /> property located in an R-3 zoning district at 71 Frog Pond Close (Map 90 Block 51) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General I. <br /> VIII <br /> i <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, it <br /> a newspaper of general circulation in the Town of Mashpee, on November 3 and <br /> I <br /> November 10, 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday,November 22, 2000, at which time the following members of the Zoning <br /> I 'I <br /> Board of Appeals were present and acting throughout: Robert G. Nelson, Frederick R. l <br /> Borgeson and Marshall A. Brem. Mr. Regan stepped down and left the room. I <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the ! <br /> I <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. l <br /> Mr. Michael Borselli of Holmes &McGrath, Inc. represented the Petition and <br /> permission under Cha I' <br /> stated that the owner was given permis ter 91 from the Conservation p <br /> Commission and the DEP for construction of a pier, ramp and float in the early 1990's. <br /> II i <br /> i <br /> However,the project was not built in compliance with the plan or the license. Mr. <br /> Borselli said that the Petitioner discovered the mistake and now wishes to gain approval <br /> for the project after construction. <br /> No comments were received from abutters. <br /> III i <br /> I ,I <br /> I! <br />
