Viglas SP-00-196 2 <br /> Board of Appeals <br /> I <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-25.I.9 states that the Board must find that the structure will not <br /> unduly interfere with the free passage of travel by water or land or cause or contribute to <br /> the substantial disruption or degradation of the marine or coastal environment. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 71 Frog Pond Close and consists of <br /> 30,640 square feet fronting on Popponesset Bay. j <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> li, II <br /> 1. the proposed dock will be an accessory to an existing dwelling and is a <br /> permissible use upon the grant of a Special Permit. <br /> 2. the proposal has been reviewed and approved by the Conservation <br /> Commission after addressing impacts on the coastal environment. Ii <br /> 3. the use is in harmonywith the general y <br /> g purpose and intent of the By-laws. <br /> 4. the owner has rights to maintenance inetui <br /> e <br /> p rP ty• <br /> 5. filing with the Corps of Engineers shall be considered execution of the Special 'I <br /> Permit. <br /> I <br /> i <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the ( il <br /> Petitioner met the criteria necessaryfor the e granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on November rl <br /> 22, 2000 to grant a Special Permit. The Special Permit is conditioned upon compliance <br /> I <br /> with plans of Holmes &McGrath, Inc. entitled"Plan Accompanying Petition of Charles <br /> J. Viglas to Maintain a Pier, Ramp and Float on Lot 4 in Shoestring Bay,Mashpee, <br /> Barnstable County, MA., Date: Oct. 06, 2000". <br /> I ji I <br /> III' ' <br />
