M a tt IH 04 U y:-❑5 R _,_-_— --- - _ _.. ----- <br /> Mashpee Zoning CB&G Realty Trust H V-00-199 2 <br /> Board of Appeals <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> i€ <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> ' III <br /> SPECIFIC FINDINGS 'fl <br /> The Board determined that: <br /> 1. the unusual trapezoid-shape and sloping topography affect the subject lot and ;i I <br /> not the district in which it is located; therefore, a literal enforcement of the <br /> By-laws would involve hardship to the Petitioner. <br /> 2. installation of a new Title V septic system would be an improvement to the <br /> property and to the neighborhood; therefore, relief may be granted without I! <br /> detriment to the public good. <br /> 3. proposed use is permissible with grant of a Special Permit and relief may be !I <br /> granted without derogating from the intent or purpose of the By-laws. j <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the II <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded,the Zoning Board of Appeals voted unanimously on November 22, <br /> 2000 to grant the following: <br /> 1. a Variance of 10.6 feet to allow for construction of the addition. Ij <br /> 2. a Variance of 25.5 feet from the front setback requirements to the existing <br /> building. <br /> I <br /> The Variance is conditioned upon compliance with plans of Baxter,Nye & <br /> Holmgren, Inc. entitled"Site Plan of Land, Proposed Addition, 33 Great Neck Road <br /> South, Mashpee, Massachusetts, Prepared for CB&G Realty Trust H, Date: 10/11/2000". <br /> I ;i <br /> j <br /> I � <br /> I <br /> j <br /> lu <br /> Ii <br />
