May lei _04. U9: U.Sp'
Celine Ritzo
16 Candlewood Lane {
Mashpee, MA 02649-2237
508-539-3334
'l
Town of Mashpee
Mashpee Zoning Board of Appeals l
16 Great Neck Road North
Mashpee, MA 02649
Reasons for Variance:
Side set back allows for construction of greenhouse, however, parcel#34 on map 21 is a
corner lot. According to Mashpee Bylaws the left "side" is also a"front" so the required j
setback is 30 feet instead of the expected 15 feet. This difference means that we cannot
legally construct our greenhouse without a variance.
1999 - looking to move out of a neighborhood (in Sandwich) with numerous
restrictive covenants where we could not have a greenhouse.
• Found a lot in Mashpee -a greenhouse being one criteria. Called Mashpee Town Hall,
gave the address and asked if a greenhouse could be built on this parcel. Told yes, and
i
that it had to be 30 feet from Candlewood. jl
• Decided to purchase lot and have home built. Wanted greenhouse constructed at same
time but could not get builder to agree because any changes to the existing plan would
have to be resubmitted.
• 2000 - House completed on June 12th and closed on July 5th. Moved in mid-July.
• August - researched options for greenhouse.
• September- decided to build ourselves. Called Building Department to check on
"footings." Told that footings could probably be 8" sona tubes and to bring the plans
in. Also told that it could not be built over septic and had to be 15 feet from the
property line.
• Brought pre-plans in: sona tubes OK'd, given necessary forms for submitting, told
there was a $40 fee and given a map and coordinates showing layout of septic. Told
holes for concrete piers had to be inspected.
• Brought back finished plans, a map of parcel showing location of green house(set 15
feet back from the left property line and 50+feet from Candlewood), necessary forms
and a check..Building materials had arrived the day before. Requested an inspection of
holes so that we could start.
• For the first time we were told it could not be built.as drawn because corner lots are
viewed as having two fronts. Therefore we needed to be 30 feet from the property line
on the left side.
