Powers of <br /> Worcester, Massachusetts for a Special Permit under Section 174-20 of the Zoning <br /> By-laws to allow for construction of an addition to a home on property located in an R-3 <br /> zoning district at 16 Bayview Road(Map 119 Block 38)Mashpee, MA. <br /> 'F <br /> I <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on November 3 and <br /> November 10, 2000, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, November 22, 2000, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Robert G. �! <br /> Nelson and Marshall A. Brem. <br /> 'I <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney David Leitner from the office of Jeffrey W. Oppenheim,Esq. <br /> i <br /> represented the Petition along with Engineer Barbara Frappier from Warwick& <br /> Associates, Inc. Plans call for removal of the existing three-bedroom dwelling to <br /> another site and construction of a new dwelling with an addition to the foundation and <br /> two decks on the subject property. <br /> Ms. Frappier said that the proposal would restore and enhance the ACEC by <br /> augmenting it with dense and numerous plantings and vegetation. <br /> Attorney Leitner stated that in 1998 the Petitioner and a neighbor purchased a lot j <br /> between the two lots, removed an existing structure, divided the lot between the two <br /> properties and eliminated a buildable lot on the wetlands. <br /> No comments were received from abutters. <br /> I' <br />
