Powers, Sr. SP-00-203 2 <br /> Board of Appeals <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br /> Laws Chapter 40A, Chapter 6, require a finding that the extension, alteration or change <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 16 Bayview Road and consists of 46,299 <br /> square feet. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the proposal does not conform to the setback requirements to water and <br /> wetlands and the Board has granted a Variance because of the close proximity <br /> of the top of coastal bank to the subject property. <br /> 2. the changes between the proposal and the prior one would result in an increase <br /> g P p p <br /> in lot coverage but it is under the allowed 20% and would not be more <br /> i <br /> detrimental to the neighborhood than the existing non-conforming use. <br /> 3. there is adequate land area to provide sufficient parking. <br /> 4. the immediate neighborhood consists of single-family homes of similar size; <br /> many of which have been improved with additions or reconstruction. <br /> I I <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion f <br /> duly made and seconded,the Zoning Board of Appeals voted unanimously on November <br /> 22, 2000 to grant a Special Permit to allow for removal of the existing home on the <br /> subject property. The Special Permit is conditioned upon compliance with Wm. M. <br /> i <br /> Warwick&Associates, Inc. plan entitled"Site Plan for 16 Bayview Road,Mashpee, <br /> Mass., Date: 6/23/99,Plan Revisions: 1/18/00, 1/25/00, 1/27/00, 3/22/00, 8/31/00, <br /> 10/12/00". <br /> i <br /> II ' <br />
