I recently observed the commencement of construction of a building <br /> which I understand to be a garage at 20 Elliot Road, the home of my next I <br /> I <br /> door neighbor Kenneth Hatcher. <br /> 7. My observance of construction of the foundation at 20 Elliot Road was a <br /> i <br /> complete surprise to me. <br /> 8. I appeared at a hearing for a Temporary Restraining Order and <br /> i <br /> Preliminary Injunction on April 13,2001. <br /> i <br /> 9. At said hearing, Defendant Kenneth Hatcher explicitly informed the court <br /> that the variance he requested from the Town of Mashpee was for a <br /> "garage"to protect his vehicle from weather and salt from the ocean. <br /> 10. I learned on April 13, 2001 that the garage was to be more than a garage. I <br /> It would contain a second floor with loft or similar area and window. <br /> i <br /> i <br /> 11. I learned on April 13, 2001 that Defendant Hatcher's building would be <br /> I I � <br /> ' i <br /> eight (8) to ten (10) feet taller than his dwelling. <br /> ! <br /> 12. My understanding is that it is the policy of the Town of Mashpee to <br /> E <br /> require any additional building in the beach or summer vacation <br /> i <br /> neighborhood to be constructed at a height no taller than the existing j <br /> dwelling on the subject property. <br /> 13. I have no objection to a garage to protect Defendant Hatcher's non- <br /> commercial vehicle from weather and salt from the ocean. <br /> I <br /> 14. I do object to the construction by Defendant of a building which contains <br /> not onlythat said protective area but also contains a second floor above E <br /> p � <br /> li <br />
