Notice was given by publication in The Mashpee Enterprise, (� <br /> a newspaper of general circulation in the Town of Mashpee, on March 23 and March 30, <br /> 2001, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on j <br /> Wednesday, 11, 2001 at which time the following members of the Zoning Board � I <br /> of <br /> i , <br /> Appeals were present and acting throughout: James E. Regan, Frederick R. Borgeson and <br /> Marshall A. Brem. <br /> I� <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A, Section 10 and the Town of f <br /> Mashpee Zoning By-laws. <br /> Mr. Ed Kovary, builder for the project,represented the Petition along with Mr. <br /> i <br /> Ozolins. Mr. Kovary stated that the Petitioner would like permission to remove one <br /> section of the existing deck in order to accommodate construction of a 13x14-foot dining <br /> room. Mr. Kovary said that the proposal would not encroach on the setbacks any further <br /> than the existing deck. Mr. Ozolins stated that his wife refuses to retire to Mashpee until a <br /> dining room is added to their home at 23 Jeep Place. i <br /> Building Commissioner Russell W. Wheeler said that the Petitioner never <br /> received a Variance to allow for construction of the deck,that the deck was built in <br /> violation of the By-laws and that the Building Department has cited the Petitioner several <br /> times. !( f <br />
