Leach, VMD SP-01-72 3 <br /> Board of Appeals <br /> Special Permit Criteria I; <br /> In accordance with § 9 of Chapter 40A, the Board determined that: <br /> 1. the proposed use and development are consistent with applicable law, rules <br /> and regulations. <br /> 2. there will be no adverse effect on public health or safety. <br /> 3. there will not be an excessive demand upon community facilities created as a <br /> result of the proposal. <br /> 4. there will not be a significant adverse impact on the environmental factors <br /> listed in Section 174-24.C.2. <br /> In accordance with § 174-25.E.7 of the Zoning By-laws, the Board determined <br /> III <br /> that the proposal is in harmony with the Section as a Veterinary establishment. <br /> I <br /> I <br /> In accordance with § 174-82 of the Zoning By-laws, the Board determined that: <br /> 1. the use may be permitted Within the Groundwater Protection District by grant of <br /> a special permit from the Zoning Board of Appeals. <br /> 2. the use is in harmony with the purpose and intent of this chapter and will promote <br /> the purposes of the Groundwater Protection District. <br /> 3. the proposal is appropriate to natural topography, soils, and other characteristics I <br /> of the site to be developed. <br /> 4. the proposal will not, during construction or thereafter, have an adverse <br /> environmental impact on the aquifer or recharge area. <br /> 5. the proposal will not adversely affect an existing or potential water supply <br /> OK <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded,the Zoning Board of Appeals voted unanimously on August 22, <br /> 2001 to grant a Special Permit. The Special Permit is conditioned upon compliance with <br /> the following: <br /> � I <br /> 1. before an occupancy permit will be issued, the Design Review Committee must <br /> visit the subject property and confirm that the Petitioner complies with all the <br /> requirements of the Design Review Committee concerning the building and <br /> landscaping. j <br /> 2. before an occupancy permit will be issued,the Petitioner must comply with all <br /> requirements of the Technical Review Committee. <br /> 3. the Petitioner must submit to the Board a$7,500 Landscape and Performance j <br /> Security. <br /> i <br /> 4. Christopher Costa plan entitled"Site Plan for Dr. John Leach in Mashpee, <br /> Massachusetts, Date: 3/16/01, Revisions: 6/21/01, 7/13/01, 7/17/01, 7/18/01, <br /> 8/03/01". <br /> 5. the Petitioner must submit a revised and detailed landscape plan of the subject <br /> property that must receive Design Review Committee approval. <br /> I <br /> I� <br /> I <br />
