O'Neill, architect for the project, stated that the proposed !I <br /> construction would be further away from the pond and that extensive landscaping of the <br /> subject property is also planned. l <br /> The Board voiced its concern over the proposed large increase in the lot coverage. <br /> The Board voted unanimously to take the Petitions under advisement until October 24, <br /> 2001. <br /> At the continued hearings on October 24, 2001,Mr. David Sanicki, engineer from <br /> Cape & Islands Engineering, and Mr. Thomas J. O'Neill, architect represented the <br /> p p � I <br /> Petition. <br /> Mr. Govoni read letters from Mr. David Foley and Ms. Maryclare Himmel in !!; <br /> opposition to grant of Variance relief from the lot coverage requirements. <br /> SPECIAL PERMIT CRITERIA <br /> § 174-20 of the Zoning By-laws states: <br /> "Rebuilding of destroyed or damaged nonconforming structure. <br /> Any nonconforming building or structure destroyed or damaged by fire, flood lightning, jC <br /> wind or otherwise may be rebuilt, subject to approval of the Board of Appeals subject to <br /> the same conditions as set forth in § 174-24 of this chapter". <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 35 Uncatena Road and consists of <br /> 10,580 square feet of land. <br /> SPECIFIC FINDINGS <br /> Per§ 174-24 of the Zoning By-laws, the Board determined that the proposed use or <br /> j! <br /> development: ! <br /> 1. is consistent with applicable state and town regulations, statutes, bylaws and til <br /> plans. l <br /> 2. will not adversely affect public health or safety. <br /> 3. will not cause excessive demand on community facilities.
