Harrison V-01-110 2 <br /> Board of Appeals <br /> GENERAL FINDINGS <br /> I { <br /> 1. that the subject property is located at 14 Pem Lane and contains 37,150 square <br /> feet fronting on Mashpee River. <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the Petitioner met the criteria for grant of a Special Permit. <br /> 2. the proposed construction will be an accessory to an existing dwelling. j <br /> 3. the proposal has been approved the Shellfish Constable whose responsibilities <br /> include protection of the marine environment. <br /> 4. the proposal has been reviewed by the Conservation Commission to address <br /> impacts on the coastal environment. <br /> j <br /> 5. the use is in harmony with the general purpose and intent of the By-laws. ` <br /> 6. the owner has rights to maintenance in perpetuity. <br /> 7. filing with the State DEP Wetlands Program shall be considered execution of <br /> the Special Permit. <br /> i <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on October 24, <br /> I <br /> 2001 to grant a Variance of 65 feet to allow for construction of a pier, ramp and float on <br /> i <br /> the subject property. The Variance is conditioned upon compliance with the following: <br /> 1. Plans of Cape & Islands Engineering entitled"Proposed Pier& Vista Pruning <br /> Located in Mashpee, MA, Prepared for Cheryl Harrison, Plan No.: 091701, <br /> Date: Sep. 17, 2001". <br /> 2.
