The Building Department was then <br /> notified of the violation. !III! <br /> ! <br /> No other comments were received from abutters. r <br /> SPECIAL PERMIT CRITERIA <br /> 'j I I l ,illi <br /> Section 174-17 of the Mashpee Zoning By-laws and Massachusetts General <br /> Laws Chapter 40A Chapter 6, require a finding that the extension, alteration or change <br /> I <br /> shall not be substantially more detrimental to the neighborhood than the existing <br /> non-conforming use. <br /> I <br /> GENERAL FINDINGS <br /> i <br /> 1. that the subject structure is one of three structures existing on a 4.5-acre f <br /> property located at 30 Baker's Road <br /> II <br /> SPECIFIC FINDINGS <br /> The Board determined that: <br /> 1. the construction conforms to the setback requirements. I' <br /> 2. the construction does not exceed the allowed 20% lot coverage. I <br /> 3. there is adequate land area to provide sufficient parking. <br /> 4. while the construction will increase the non-conforming nature of the <br /> structure, the changes will not result in a structure or use which is more <br /> detrimental to the neighborhood than the prior non-conforming structure and <br /> its use. k <br /> In view of the foregoing, the Mashpee Zoning Appeals Board of A eals found that the j ill <br /> Petitioner met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on November it <br /> I <br /> 14, 2001 to: <br /> 1. grant the Special Permit to the dwelling situated 27 feet south of the northerly <br /> property line as shown on plan entitled "Millennium Design Group, Inc., i I <br /> Drawing Name: Site Plan, #30 Baker Road, Mashpee, MA, Date: 3/9/01, <br /> I ! II <br /> Project Name: T. Dayos+P. Dobyns, Ex. Two (2)-Sty. Dwelling, 30A". I I <br /> I <br /> 2. demand that, prior to making changes of any kind to any of the structures on <br /> the subject property, the Petitioner must apply for and receive authorization <br /> I I I <br /> from the Zoning Board of Appeals and/or other appropriate Town Boards j <br /> I ilii �, <br /> and/or Commissions. <br />
