Virgilio of Mashpee, <br /> Massachusetts for a Special Permit under Section 174-25.I.12 of the Zoning By-laws j <br /> for permission to park and use a trailer for temporary occupancy on property located in <br /> an R-3 zoning district at 127 Whippoorwill Circle (Map 125 Parcel 31B) Mashpee, MA. <br /> I � <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on November 23 and <br /> November 30, 2001, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 12, 2001, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert G. Nelson, Frederick R. <br /> Borgeson and Marshall A. Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the I <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Ernest S. Virgilio represented his Petition and submitted photos of his home <br /> on the subject property. He stated that the dwelling is in need of major repairs due to <br /> extensive rot. Mr. Virgilio said that some of the weight inside the home has been <br /> reduced; however, the home cannot be occupied once repairs commence. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 127 Whippoorwill Circle and consists of <br /> I � <br /> 12,710 square feet of land.
