Brem and Borgeson told Mr. Bucuvalas that the Board has jurisdiction `" <br /> over building height, proposed setbacks and lot coverage. <br /> j <br /> Mr. Nelson read a letter dated December 5, 2001 from Mr. John F. Woods, Sr., an abutter <br /> at 24 Elliot Road, in approval of the proposal. <br /> Mr. Brem said that he understands and respects the concerns and frustration that Mr. and <br /> A <br /> Mrs. Bucuvalas have. Mr. Breen referred to thephotos of Mr. Hatcher's shed and asked <br /> "What is this supposed to tell us?" Mr. Bucuvalas said that he didn't know and Mrs. <br /> Bucuvalas said that she took pictures "at all different angles". The photos show trash and <br /> other debris strewn across Mr. Hatcher's property. Mr. Brem repeated that he understood <br /> the point and admitted that he "wouldn't want any of that in my back yard"; however <br /> Mr. Brem said "that this is not the place to discuss this point." <br /> Mr. Hatcher submitted several letters from abutters in approval of the proposal, which <br /> Mr. Nelson read. p <br /> L <br /> Mr. Brem asked why windows were installed over theara e <br /> when w <br /> it i <br /> g g , s onlygoing to be <br /> g � <br /> used for storage. Mr. Hatcher said that it"would look better". Mr. Brem observed that <br /> "wood is less expensive than glass". He also said that Mr. Hatcher should have known :a <br /> that he needed an outside stairwell. Mr. Hatcher said that he always intended on building <br /> an outside staircase, but that it was an oversight on the <br /> original plans. Mr. Brem <br /> expressed concern that removal <br /> of the shed would not be done in a timely manner. <br /> Mr. Nelson questioned if Mr. Hatcher needed ZBA approval to construct the steps since <br /> there would be no change in the Zoning or the Variance relief being sought. Building <br /> Commissioner Wheeler said that a change in the footprint requires ZBA approval. <br /> Mr. <br /> Borgeson g son moved to grant the Modification to the Variance V-00-212 <br /> subject to plan i <br /> dated 12/22/00, revised 11/3/01. Mr. Breen seconded. All agreed. The Board reminded <br /> Mr. Hatcher that the Variance is conditioned upon removal of the shed as soon as <br /> construction of the garage is completed. <br /> ii <br /> I <br /> Mr. Brem advised Mr. and Mrs. Bucuvalas to notify the proper department with their <br /> concerns. Mr. Borgeson suggested that they start with the Building Department. <br /> i <br /> Shirley Bruneau—Requests a Variance from the lot size requirements as required in <br /> Section 174-31 of the Zoning By-laws and that the Zoning Board of Appeals determine <br /> that the property located in an R-5 zoning district at 310 Main Street, Mashpee, MA <br /> (Map 36 Parcel 55) is a separate and buildable lot. <br /> I <br />
