i <br /> Mashpee Zoning Minutes—December 12, 2001 <br /> Board of Appeals 7 <br /> Shirley Bruneau—Requests a Variance from the lot size requirements as required in <br /> Section 174-31 of the Zoning By-laws and that the Zoning Board of Appeal determine <br /> that the property located in an R-5 zoning district at 310 Main Street Mashpee, MA <br /> (formerly known as Map 36 Parcel 35A) is a separate and buildable lot. I <br /> Sitting: Robert G. Nelson, Frederick R. Borgeson and Marshall A. Brem. <br /> Mr. and Mrs. Robert Sculos, realtors from Today Real Estate, represented the Petitioner. j <br /> Mrs. Bruneau also attended the meeting. Mr. Sculos stated that the Petitioner is seeking <br /> I <br /> the same Variance relief from the lot size and frontage requirements as granted by the <br /> Board in 1998. In 1987 the ZBA also granted the Petitioner a Variance from the frontage <br /> requirements due to a surveying error that combined the two lots. Mr. Nelson asked if <br /> the plan of the subject property has been recorded at the registry. Mr. Sculos said that the �! <br /> plan is recorded and that the Petitioner has separate deeds to both of the properties., <br /> Mr. Nelson asked if the lots were combined at the owner's request. Mr. Sculos said that <br /> I <br /> approximately 18 months ago and prior to her husband's death, Mrs. Bruneau asked for <br /> the lots to be combined in order to to <br /> wer her tax bill. The lots are currently taxed as one <br /> developed lot and one unbuildable lot. Mr. Brem questioned if the Petitioner needs <br /> Planning Board approval. Mr. Nelson said that the plan is recorded at the registry as two <br /> lots and that the Petitioner went to the Assessing Department and asked for the lots to be j <br /> combined into one lot in order to reduce the taxes. Mrs. Bruneau said that she wants to <br /> sell the property as two separate and buildable lots so that she can make more money in <br /> the sale and move off--cape. <br /> No comments were received from abutters. <br /> Mr. Nelson suggested that the Board continue the Petition to allow for research and Town j <br /> Counsel opinion. Mrs. Bruneau asked for the Petition to be postponed indefinitely <br /> because she would be leaving the area for several months in January. Mr. Sculos asked if <br /> Mrs. Bruneau has to attend the meeting in January. The Board said that Mr. Sculos could <br /> represent her in her absence. : <br /> Mr. Borgeson moved to continue the Petition until January 9, 2001. Mr. Brem seconded. <br /> All agreed. <br /> Ernest S. Virgilio—Requests a Special Permit under Section 174-25112 of the Zoning <br /> By-laws for permission to park and use a trailer for temporary occupancy on property <br /> located in an R-3 zoning district at 127 Whippoorwill Circle (Map 125 Parcel 31B) <br /> Mashpee, MA. <br /> Sitting: Robert G.
