Nelson, Frederick R. Borgeson and Marshall A. Brem. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petition. The Board <br /> granted a Special Permit and Variance on the above-referenced property at the Public <br /> Hearings on September 19, 2001. Mr. and Mrs. James H. Mitchell, abutters at 106 <br /> Waterway, appealed ealed the Decisions. Mr. Mitchell stated that he appealed the Board's <br /> Decisions because he failed to attend the Public Hearings in September and was unaware <br /> of the extent of the relief being sought. <br /> ' I <br /> After the appeal, the Petitioner revised construction plans and eliminated the need for <br /> Variance relief from the side setback requirements. Mr. Mitchell indicated that he would <br /> release his pending litigation on the subject property if the Petitioner eliminated the <br /> request for a Variance from the side setback requirements. The Conservation j <br /> Commission has approved the proposal and issued an Order of Conditions. <br /> j i I it <br /> Mr. Brem moved to grant a Special Permit to allow for demolition of the existing <br /> structure on the subject property, subject to the following: <br /> • findings 2 through 12. <br /> �! <br /> that the Petitioner shall submit proof to the ZBA that all pending litigation against the � <br /> subject property has been resolved. <br /> Mr. Nelson seconded.
