Town ofMashillee <br /> Decision for a Six-month Extension 16 Great Xeck Poad f Vor°th <br /> Nlashpee, Massachusetts 02649 <br /> RE: Willowbend Development Corporation Shoestring Bay Estates <br /> V-98-33 to V-98-67 <br /> A Petition was filed on February 27, 1998 by Willowbend Development <br /> Corporation of Mashpee,Massachusetts for a Variance from Section 174-31 of the <br /> Zoning By-laws for permission to vary the minimum lot size requirement for the <br /> properties listed on Schedule A, all of which are located in an R-3 zoning district and <br /> shown on Plan of Shoestring Bay Estates dated May 6, 1998, recorded with Barnstable <br /> County Registry of Deeds at Book 541 Page 26. <br /> At the Public Hearing held on July 22, 1998 the Board of Appeals, upon motion <br /> duly made and seconded, granted Variances from the minimum lot size requirements for <br /> the lots listed on Schedule A. A copy of Schedule A is attached hereto and made a part <br /> hereof. <br /> On July 7, 1999, the Board of Appeals received a request from the applicant for <br /> an extension of the above-referenced Variances. <br /> At the Public Hearing on July 14, 1999, the Board of Appeals voted unanimously <br /> to grant the extension for a period of six months. This was allowed in compliance with <br /> Massachusetts General Laws Chapter 40A, Section 10,which reads "If the rights <br /> authorized by a variance are not exercised within one year of the date of grant of such <br /> variance such rights shall lapse;provided,however, that the permit granting authority in <br /> its discretion and upon written application by the grantee of such rights may extend the <br /> time for exercise of such rights for a period not to exceed six months; and provided, <br /> further,that the application for such extension is filed with such permit granting authority <br /> prior to the expiration of such one year period". <br /> r <br /> IN FAVOR: -, � -- <br /> IN FAVOR: �'�/ c�a� <br /> IN FAVOR: <br /> i <br /> 0I :0 Gc4 S <br /> 0.1 <br /> x <br />
