Town of Mash ee <br /> Decision for a Six-month Extension <br /> 16 Gr-eat ,Veck Poad�cai°tta <br /> Mashpee, Massachusetts 02649 <br /> RE: William Cohen V-98-116 9 Chart Way <br /> Map 106 Block 17 <br /> A Petition was filed on August 19, 1998 by William J. Cohen of Mashpee, <br /> Massachusetts for a Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the front setback and lot coverage requirements on property located in an R-3 <br /> zoning district at 9 Chart Way(Map 106 Block 17),Mashpee, MA. <br /> At the Public Hearing on September 23, 1998,the Board of Appeals voted <br /> unanimously to grant the Variance of a five-foot front setback and 22% lot coverage. <br /> On June 21, 1999 the Board of Appeals received a request from the applicant for <br /> an extension of the above-referenced Variance. <br /> At the Public Hearing on July 14, 1999, the Board of Appeals voted unanimously <br /> to grant the extension for a period of six months. This was allowed in compliance with <br /> Massachusetts General Laws Chapter 40A, Section 10,which reads "If the rights <br /> authorized by a variance are not exercised within one year of the date of grant of such <br /> variance such rights shall lapse;provided, however,that the permit granting authority in <br /> its discretion and upon written application by the grantee of such rights may extend the <br /> time for exercise of such rights for a period not to exceed six months; and provided, <br /> further,that the application for such extension is filed with such permit granting authority <br /> prior to the expiration of such one year period". <br /> J� <br /> IN FAVOR: . <br /> IN FAVOR: <br /> i <br /> � <br /> IN FAVOR: <br /> f y } ry FF <br />
