DRAFT <br /> Decision Town Clerk <br /> RE: Notice of Constructive Approval/Failure of Board of Appeal's To Act Upon Appeal of Building <br /> Inspector's Denial of Building Permit I l Taffrail Way, Mashpee(A-99-66) <br /> A Notice of Appeal was filed on July 30, 1999,by Fasanella Johnson&Wood P.C. regarding the Building <br /> Inspectors's denial of Mr. Kenneth Litvack's application for a building permit for the construction of a <br /> garage to be located at 11 Taffrail Way,Mashpee. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice <br /> was given by publication in The Mashpee Enterprise,a newspaper of general circulation in the Town of <br /> Mashpee,on August 6, 1999,and August 13, 1999. <br /> A Public Hearing was held on the Appeal at the Mashpee Town Hall on Wednesday,August 25, 1999, at <br /> 7:30 P.M., at which time the following members of the Board of Appeals were present: Robert G.Nelson, <br /> James E. Regan 111,Edward M. Govoni,James M.Dorgan,and Richard T. Guerrera. <br /> At the hearing,the applicant requested a continuance and was approved until October 27, 1999. On <br /> October 27, 1999, no continuance was requested by the applicant and no action taken by the members of <br /> the Zoning Board of Appeals. <br /> Massachusetts General Laws 40A, Section 15, states that the Zoning Board of Appeals will render a <br /> decision on an Appeal within one hundred(100)days. Since the appeal was submitted on July 30, 1999, <br /> the one hundredth day would be November 7, 1999. Pursuant to Massachusetts General Laws,Chapter <br /> 40A, Section 17,a twenty(20)day appeal period November 8, 1999. The appeal period expired on <br /> November 28, 1999.
