Town of Mashpee <br /> 3 <br /> MASH PEE ZONING BOARD OF APPEALS 16 Great Xeck Pvoad Anti <br /> Decision for a Special Permit Mashpee, Massachusetts 02649 <br /> RE: Stuart Bornstein SP-99-94 106 Falmouth Road <br /> Map 54 Block 5 <br /> A Petition was filed on September 17, 1999 by Stuart Bornstein of Hyannis, <br /> Massachusetts for a Special Permit under 174-55.0 of the Zoning By-laws for permission <br /> to erect permanent signage on property located in I-1 and R-3 zoning districts at 106 <br /> Falmouth Road(Map 54 Block 5)Mashpee, MA. (Owner of record: Duck Pond Limited <br /> Partnership). <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on October 8 and October 15, <br /> 1999, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 27, 1999, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: James E. Regan III, Robert G. Nelson <br /> and Zella E. Elizenberry. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> On October 27, 1999, the Board received a fax from Stuart Bornstein requesting <br /> continuance of his applications to allow him an opportunity to resolve signage issues with <br /> the Design Review Committee. The Board voted unanimously to continue the hearings <br /> until November 10, 1999. <br /> On November 10, 1999, Mr. Bornstein represented his applications for signage <br /> and stated that he has taken ownership of the former Augat building on Route 28. The <br /> sign will display the words "Mashpee Commerce Center". Mr. Bornstein stated that the <br /> Design Review Committee has requested revisions on the proposed sign. The Design <br /> Review Committee will also review the landscaping in the spring to ensure that it <br /> complies with the Committee's requirements. <br />
