Mashpee Zoning Stuart Bornstein SP-99-94 2 <br /> Board of Appeals <br /> i <br /> Mr. Bornstein submitted a request for withdrawal of the Variance application. <br /> The signage has been greatly reduced from its original proposal and is now under the 40 <br /> square feet allowed by the Zoning By-laws. There is no need for a Variance from the <br /> Board. <br /> No comments were received from abutters. <br /> GENERAL FINDINGS <br /> 1. the subject property is located at 106 Falmouth Road and consists of 13.3 <br /> acres of land. <br /> SPECIAL PERMIT CRITERIA <br /> Section 9 of Chapter 40A and Section 174-24C of the Mashpee Zoning <br /> By-law require that the permit granting authority determine that the proposed use <br /> and development are consistent with applicable law, rules and regulations; that there <br /> will be no adverse effect on public health or safety; that there will not be an excessive <br /> demand upon community facilities created as a result of the proposal; and that there <br /> will not be a significant adverse impact on the environmental factors listed in Section <br /> 174-24.C.2. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded,the Zoning Board of Appeals voted unanimously on November <br /> 10, 1999 to grant a Special Permit allowing the applicant to erect permanent signage on <br /> property located in I-1 and R-3 zoning districts at 106 Falmouth Road. The permit is <br /> conditioned upon the following: <br /> I. that Mr. Bornstein shall set two stakes in the ground on the subject site, <br /> representing the base of the sign. <br /> 2. that the location of the stakes is to be approved by the Building Commissioner <br /> prior to the erection of the sign. <br /> 3. that after the erection of the sign and a permanent site plan is prepared, the <br /> sign shall be included upon said site plan. <br /> 4. that the said sign shall meet the approval of the Design Review Committee. <br />
