Mashpee Zoning Mashpee Industrial Park Realty Trust SP-99-97 2 <br /> Board of Appeals <br /> GENERAL FINDINGS <br /> 1. the subject property is located at 64 Industrial Drive and consists of 83,226 <br /> square feet. <br /> 2. the proposed building will be used for rental units for business allowed by <br /> Special Permit from the Zoning Board of Appeals. <br /> SPECIAL PERMIT CRITERIA <br /> Section 9 of Chapter 40A and Section 174-24C of the Mashpee Zoning By-laws <br /> require that the permit granting authority determine that the proposed use and <br /> development are consistent with applicable law, rules and regulations;that there will be <br /> no adverse effect on public health or safety;that there will not be an excessive demand <br /> upon community facilities created as a result of the proposal; and that there will not be a <br /> significant adverse impact on the environmental factors listed in Section 174-24.C.2. <br /> SPECIFIC FINDINGS <br /> 1. that the proposed uses are consistent with the industrial uses allowed in the <br /> Mashpee Industrial Park. <br /> 2. that the proposed uses will not create traffic congestion in the Industrial Park. <br /> 3. that the proposed uses will not adversely affect public health, safety or <br /> welfare,will not create an excessive demand upon municipal services and <br /> facilities and will not have a significant adverse impact on the environment. <br /> 4. that the Board found that the granting of a Special Permit would not be <br /> detrimental to the Town. <br /> 5. that the Board granted a Special Permit to the subject property in 1996 <br /> Special Permit SP-96-53. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a Special Permit. Upon motion <br /> duly made and seconded, the Zoning Board of Appeals voted unanimously on October <br /> 27, 1999 to grant a Special Permit, subject to the following conditions: <br /> 1. the Special Permit is granted for the uses allowed by the following Sections of <br /> the Zoning By-laws only: <br /> 174-25.D.1, 174-25.D.2, 174-25.D.3, 174-25. D.4 <br /> 174-25.G.2, 174-25.G.3, 174-25.G.4. <br /> 2. the applicant will review plans with the Design Review Committee and any <br /> revisions must be approved by the Zoning Board of Appeals. <br /> 3. the applicant must post a landscape bond of$5,000 with the Town Treasurer. <br /> 4. the building will be limited to a maximum of eight rental units. <br /> 5. the building will be constructed upon submission of and compliance with <br /> professionally engineered and signed plans as approved by the Chairman of <br /> the Zoning Board of Appeals. <br />
