SP-98-130 2 <br /> FINDINGS <br /> General <br /> 1. the subject property is located at 766 Falmouth Road and consists of <br /> 271,799.55 square feet. <br /> Special Permit Criteria <br /> Section 9 of Chapter 40A and Section 174-24.0 of the Mashpee Zoning By-laws <br /> require that the permit granting authority determine that the proposed use and <br /> development are consistent with applicable laws, rules and regulations;that there will be <br /> no adverse effect on public health or safety;that there will not be an excessive demand <br /> upon community facilities created as a result of the proposal; and that there will not be a <br /> significant adverse impact on the environmental factors listed in Section 174-24.C.2. <br /> In view of the foregoing, the Mashpee Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Special Permit. Upon motion duly made <br /> and seconded, the Board of Appeals voted unanimously on October 14, 1998 to grant the <br /> Special Permit with the following conditions: <br /> 1. that the two storage containers not to exceed lot coverage of an area twenty <br /> feet by forty feet. <br /> 2. that the Permit is valid for a twelve-month period, to be renewed annually. <br /> The Permit is conditioned upon reference to Land Court Plan of Land in Mashpee, <br /> Mass., being a subdivision of Land Court Case 38936A, dated December 27, 1984, Baxter <br /> &Nye Inc. Registered Land Surveyors, Osterville, Mass. <br />
