Board of Appeals Doe Family Trust/99 West Inc. SP-96-12 3. <br /> The Board of Appeals made the following findings: <br /> 1. The subject property is situated at the corner of Ryan's Way and Great Neck <br /> Road,North in a C-1 Zoning District. <br /> 2. The parcel consists of 2.07 acres and has a combined frontage in excess of four <br /> hundred fifty(450) linear feet on both of the ways which abut the parcel. <br /> 3. The property is serviced by a public water supply and the Applicant proposes <br /> the installation of a subsurface sewage disposal system in conformance with the <br /> requirements of Title V. <br /> 4. The proposed restaurant building will consist of fifty-seven hundred (5,700 sq. <br /> ft.) square feet, and will have a seating capacity of one hundred fifty-eight <br /> (15 8) patrons. <br /> 5. The proposed parking area will accommodate one hundred thirty-five (135) <br /> spaces,(including handicap). <br /> 6. The site will also have a connector to the adjacent Stop and Shop commercial <br /> complex. <br /> 7. The proposal was reviewed and approved by the Design Review Committee. <br /> 8. The proposed use requires a Special Permit from the Zoning Board of Appeals. <br /> 9. The Applicant has offered to introduce a denitrification component to its septic <br /> system design. <br /> 10. The Board determined that the proposed use is consistent with applicable law, <br /> rules and regulations, will not adversely affect public health, safety or welfare, <br /> will not create an excessive demand upon municipal services and facilities and <br /> will not have a significant adverse impact on the environment in general. <br /> 11. The Board found that the granting of a Special Permit would not be <br /> detrimental to the neighborhood or to the Town as a whole. <br />
