The proposed restaurant building will consist of fifty-seven hundred (5,700 sq. <br /> ft.) square feet, and will have a seating capacity of one hundred fifty-eight <br /> (158) patrons. <br /> 11. The site will also have a connector to the adjacent Stop and Shop commercial <br /> complex. <br /> 12. The proposal was reviewed and approved by the Design Review Committee. <br /> 13. The Board found that a literal enforcement of the By-laws would produce a <br /> substantial hardship. The hardship relates to the shape and circumstances of <br /> said lot being bounded by two (2) ways open to the public and a third paper <br /> way which significantly impacts the location of the building and its accessory <br /> septic system. <br /> 14. The Board found that the granting of the requested Variance relief would not <br /> derogate from the intent of the By-laws nor would it be a detriment to the <br /> neighborhood. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously on <br /> January 24, 1996 to grant the following: <br /> 1. A Variance from Section 174-40 of fifty-one (51') feet to allow one hundred <br /> and forty-nine feet (149') between the radius of the entryway into the subject parcel from <br /> the right of way on Great Neck Road North. <br /> 2, A Variance from Section 174-40 of one hundred and ten feet (110') to allow <br /> ninety feet (90') from the radius of the entryway into the subject parcel to the accessway <br /> of the adjacent condominium property on Ryan's Way. <br /> 3. A Variance from Section 174-38 to vary the size of the parking spaces from 9' <br /> x 20' to 9' x 18' and a reduction of thirty (30') feet of the square footage required per <br /> space. <br /> This Decision is conditioned upon compliance with plans of Daylor Consulting <br /> Group, Inc. revised January 24, 1996. <br />
