REGARDING: R'w <br /> Reference is made to a Special Permit Decision issued by the Mashpee Planning Board, <br /> dated April 15, 1987 and recorded with the Barnstable County District Registry of b <br /> Deeds at Book 5707, Page 290, as amended from time to time (hereinafter the "Special r <br /> Permit"). By decision dated August 7, 1991, the Special Permit was transferred to <br /> Bent Twig Limited Partnership whose interest was subsequently assigned to <br /> Willowbend Development Corporation. Willowbend Development Corporation is <br /> hereinafter referred to as the "New Owner" or "applicant". The Special Permit <br /> ti <br /> authorizes construction of a residential/golf course community known as Willowbend !` �.�• <br /> south of Route 28 in East Mashpee the "Project"). <br /> 4fi <br /> H. JURISDICTION: <br /> This modification is issued pursuant to Sections 9.3 and 9.4 of the Mashpee Zoning <br /> By-Law as they existed on November 6, 1985 and applicable provisions of M.G.L. FACTS AND FINDINGS: d '� ,, „➢� <br /> At a public hearing held on March 6, 1996, and continued on March 20 and April 3 the ® ;; "Ilk, <br /> applicant presented the Planning Board with a proposed further modification to the <br /> Special Permit Plans showing a modified site plan in the area of Stirling Road, north of <br /> Quinaquisset Avenue and west of Willowbend Drive. The proposed modification <br /> shows the layout of a modified subdivision road and the creation of 27 housing sites <br /> which will be developed as condominium units under Section 9.3. The proposed <br /> changes are shown on two sets of plans, the first of which is entitled "Definitive <br /> Subdivision Plan, Willowbend Phase II, Mashpee, Massachusetts" (the "Definitive <br /> Plans") and the second of which is labelled "Willowbend Phase IL Mashpee, Mass. <br /> consisting of grading and utility sheets, plans and profiles and construction details, <br /> drawn by DeFeo, Wait & Par6 (the "Site Plans") copies of which were filed with the '41 <br /> Board and which are listed on Schedule A to this Modification. There are no changes <br /> proposed to the exit and entrance point to Quinaquisset Avenue and the new road <br /> Cdr! <br /> layout will be largely limited to the clearing undertaken by the prior owner for the <br /> prior configuration. The new layout of housing sites reflects the development of larger d •„; ,,:.a <br /> lots and the provision of more internal open space along the roadway. The Board finds "P a <br /> that the changes to the area do not differ significantly from the layout of this area as <br /> shown on the original Special Permit Plan.
