The applicant has also agreed to upgrade the <br /> existing PVC water line running out to Quinaquisset Avenue with a ductile iron line <br /> from the Town well. < <br /> The applicant also requested that lots 8, 51 and 52 and 53 be released from the <br /> obligations under Condition No. 20 of the Special Permit to tie into the sewage l' <br /> treatment plant and be allowed to use interim septic systems until such time as DEP . ' <br /> amends its regulations to allow single family subdivision lots to be connected to the <br /> sewage treatment plant. The applicant presented evidence indicating that because of the p an�r'y� b <br /> redesign of the lotting scheme in the area of these lots, there was no longer sufficient <br /> pressure in the existing sewer lines to allow those lots to be connected to the sewage <br /> treatment plant. The applicant also agreed to connect lot 30, which had previously <br /> been approved for use of an interim septic system, to the sewage treatment plant as the <br /> applicant had recently acquired that lot from the original purchaser. 'ND <br /> Based on the foregoing and additional information presented at the meeting, the Board ', ��� <br /> finds that the development as herein modified is to be constructed in substantial <br /> compliance with the requirements of the original Special Permit. The Board also finds, i��1114 <br /> for <br /> , <br /> for reasons enumerated above, that the modifications sought are: (1) consistent with, , � <br /> and do not derogate from, the intent of the Zoning By-law; (2) in general harmony with <br /> the purposes and intents of the Zoning By-law; (3) in compliance with the provisions of <br /> M.G.L. c. 40A, Section 9 and applicable provisions of the Zoning By-law including .i k ' <br /> requirements of Sections 9.3 and 9.4; and (4) in furtherance of the public good and not <br /> substantially detrimental to adjoining land. ;,". <br /> IV. MODIFICATIONS: <br /> 1. The applicant shall be authorized to construct up to 27 condominium units along the <br /> new subdivision roads as shown on the Site Plans. Buildings (other than garages, F . <br /> shedsgreenhouse or cabana) must be separated from other buildings on the lot by not <br /> less than twenty feet. Or <br /> .a °.►, , , <br /> 2. The applicant shall grant to the Town of Mashpee Water District an easement to �� ��►'.- ; <br /> maintain and repair the water line running beneath the land and serving areas outside <br /> the subdivision. The easement will run from Town land to the north of the subdivision <br /> in an easterly direction in the area designated on the Definitive Plans as "Proposed 20' x'° <br /> Wide Utility Easement" to the westerly side of Stirling Drive, then in a southwesterly <br /> direction inthe area shown on the Definitive Plans as "7' Utility Easement Parallel and ! <br /> Concentric" <br /> on the western side of Stirling Drive out to Quinaquisset Avenue. <br /> 3.
