(A road taking Article) Article 44: <br />To see if the Town will vote to accept the layout of Amanda Way <br />as a public way as shown on a Plan entitled, Layout of Amanda <br />way, located in Mashpee, MA, which layout will have been filed <br />in the Office of the Town Clerk not later than seven (7) days <br />prior to the date of the vote hereunder and to authorize the <br />Board of Selectmen to acquire by purchase or eminent domain <br />taking any land necessary for the purposes of such way as so laid <br />out and to raise and appropriate transfer from available funds or <br />borrow a sum or sums for such purchase or taking including <br />borrowing costs therefor and to further authorize the Board of <br />Selectmen to access betterments to the owners of the land <br />abutting the way or take any other action relating thereto. <br />Thomas Fudala mentioned Amanda Way is a road with <br />construction problems. Charles Rowley commented the grading, <br />loam and seed and the back slope have never been finished. <br />$3,000.00 in surety is still owed. <br />Mr. Fudala stated the origin of the Article is for the Town <br />to fix the problems and charge betterments. This Article has <br />been submitted by Petition. <br />MOTION: Robert Govoni made a Motion to recommend approval; <br />which Motion was seconded by Dennis Balzarini and so voted <br />unanimously. <br />Thomas Fudala made mention of a Petition Zoning Article #49 <br />which had been submitted without a Planning Board Public Hearing. <br />There is an irate petitioner because the By -Law change cannot be <br />acted upon at Town Meeting. The Article was to expand the <br />Groundwater Protection District in order to protect the entire <br />zone II of the Holland Mill Well. Mr. Fudala has spoken with <br />Petitioner, Donna McCaffery, and has apologized for the <br />inconvenience and has offered to assist her in readying the <br />Article for May Town Meeting, which Article he would support. <br />Thomas Fudala suggested the Board call a scheduled Hearing <br />and announce its postponement to some later time in the evening. <br />To which suggestion the Chairman agreed, and asked the Clerk to <br />remind him to call a scheduled Hearing on time. <br />Public Hearing <br />Mashpee Land Investment Ltd. Partnership -Richard Kelly <br />Approval of 11-Lot Definitive Plan filed August 7, 1996 <br />The Chairman called the Public Hearing to order at 10:05 <br />p.m. and recognized William Silvia for an update. Mr. Silvia <br />made reference to the wells Plan - Definitive Subdivision Plan, <br />608 Great Neck Road South, Mashpee, MA, S&R Land Surveying. <br />Notes have been added to the Plan for access over the lots to <br />the wells. One well needs to be moved, there is a proposed <br />location for it. <br />-19- <br />
