The Restriction was originally suppose to be granted aq <br /> as part of the 1987 Special Permit, for various reasons that <br /> never happened. There was a general agreement with the Board <br /> that when there was a Modification to the Special Permit, the <br /> Restriction would be negotiated and put on record. When <br /> Windchime came in four (4) years ago and discussed Modification, " <br /> the Restriction was at that time both to the Town and to the <br /> Trustees, the reason being that under state law the Restriction <br /> had to be held by the Town. In terms of the coverage of the <br /> Restriction, the original Special Permit required that areas <br /> beyond twenty (20) feet from foundations and ten (10) feet from <br /> driveways not be touched. The division line was an <br /> administrative line discussed by the Trustees and the Town in <br /> terms of division of responsibilities. The Trustees would be +I,) <br /> responsible for the natural area along the Mashpee River, the <br /> area around the buildings, because they were protecting the light <br /> and space of residents and abutters and the street, were the <br /> domain of the Town. The division line reflected Trustee/Town <br /> responsibility for enforcing Conservation Restriction. �q�9h <br /> Attorney Butler agreed Mr. Wyman' s interpretation was <br /> accurate. -13- <br />
