Pot,
a'a
impacted by the construction. Mr. Traczyk stated that he felt
the Association did not want to deal with construction work going
'► on when two buildings are occupied and years later the developer
returns to build another between them. Mr. Traczyk said he felt
! ,aF that situation would be disruptive, and that he would like to
make sure this community builds out itself in an organized manner
so that everybody understands what is being built, where and
'I• 1' ° '^ai when.
Attorney Butler agreed Mr. Traczyk' s concerns were very
legitimate and appropriate. But he did point out the difference
between saying, there is no phasing schedule. Attorney Butler
said he was informed that the meeting "the other night" was such
that there was an opportunity for the unit owners to tell Mr.
^ M '' Bornstein what their concerns were. He indicated that what he
is hearing tonight is substantially more than that. He is
F; hearing that there is absolutely nothing about this plan to talk
'tl y,. ► ,. about. Attorney Butler then suggested sitting down with the unit
owners and legal representative and determine their concerns,
what they will allow Mr. Bornstein to meet the concerns, discuss
the jurisdiction of the Cape Cod Commission and/or the status of
,; u T
\ d • the Special Permit.
I
Attorney Butler requested the Board continue the Hearing to
allow for an opportunity to receive the Minutes of this Hearing
II►' ; !; and respond to comments made.
The Chairman agreed there are several different opinions
regarding legal issues, planning, land use and design issues,
etc. The Chairman suggested legal counsel address some of these
issues. Perhaps some of the planning land use issues could also
be resolved. As Chairman of the Board, Mr. Ferragamo said that
Ail he is in favor of allowing an opportunity of the involved parties
^ + " to meet in an attempt to address some of the issues raised.
The Chairman also stated there had been issues raised during
a a
the course of this Hearing that the Board had not been aware of
made by counsel for the unit owners. He suggested respective
, counsels needed time to address and develop some of the issues
`'q.A., raised. He suggested the possibility of the Board being informed
as to the status of some of the primary issues.
' '0:
Attorney Butler requested, due to the nature of the Purchase
and Sale Agreement (a copy of which will be provided to the
Board) time constraints, a continuance.
14 `vs "41,
11
, u ., The Chairman recognized Jean Brown, unit owner #6, who
,• , 14ji" stated, the reason Attorney Butler is hearing a different tone
w tonight from the unit owners than at the meeting with Mr.
i i k Bornstein is that when the unit owners expressed dissatisfaction
with the new proposal, they were told that the old plans were
'',►"; "' totally inaccurate, the buildings would not fit on the site. For
this reason the unit owners were amenable to compromise.
  -27-
