Brown said they <br /> much want the original plan, but were told that it was totally `i� <br /> inaccurate, that it was submitted and approved by the Planning <br /> Board (in whatever year it was) , but that it was absolutely <br /> useless. Ms. Brown further stated that if indeed the original •,, <br /> plans are correct, they want that plans <br /> r-" <br /> Attorney Butler responded for the record the following two <br /> issues: Did the final plan as approved by this Planning Board 4;1�" '11; <br /> realistically, practically and economically allow for <br /> construction in the format that you see on that plan. The answer !'I <br /> that this particular Applicant has come up with is, ,No. ,, "It rl'V� .;� <br /> doesn' t work. " <br /> Jean Brown commented, "Well, that' s a different story than saying that it ' s an inaccurate plan. ,, <br /> Attorney Butler said that it has been his experience dealing <br /> with this project in the last few months that if Mr. Bornstein <br /> used those words, that what they have discovered is that the plan <br /> doesn' t make any sense from the standpoint of how it is proposed. <br /> He stated they have tried to work within the confines of what is <br /> there. He suggested that the Engineers might be able to explain <br /> better at the continued Hearing or at a dialogue in the interim. <br /> Attorney Ford stated that if it is concluded that the <br /> Special Permit Plan is one that doesn't work for a variety of <br /> reasons, how would you be able to show that you are entitled to a <br /> continued exemption from the Cape Cod Commission because what you ��� � <br /> are doing is substantially in compliance with the plan- <br /> Attorney Butler made a point to be clear for the record, <br /> " . . .We do not believe that this is anything substantially ;i� <br /> different that would require a lapse of the Special Permit or <br /> Cape Cod Commission jurisdiction. " <br /> The Chairman determined that respective counsel are to work � �'•.!� . <br /> on that issue. <br /> The Chairman then opened the Hearing to any further Board <br /> questions, comments or discussion.
